Tiffany Cabán: Champion of Sex Workers’ Rights

Campaigning for district attorney of NYC, Tiffany Cabán initially declared victory on election night, June 25, 2019, but a full recount is currently ongoing due to how close the original count was after absentee ballots were figured in. The process is expected to take a few weeks.

If victorious, Canán would be the first queer Latina Democratic nominee for District Attorney in Queens. It will be a huge victory for sex workers. The 31-year-old former public defender has served New York County and the Legal Aid Society for 6 years. Ms. Cabán campaigned on a platform of criminal-justice reform, including the decriminalization of sex work.

Cabán’s win, over Democratic organization-backed Melinda Katz, was recalled after Board of Education representatives began tallying paper votes after the primary. The BOE predicts the recount, which began on July 9, will take a minimum of 10 days. Democratic nominees historically run unchallenged in Queens, so the winner will likely serve as the next District Attorney.

Despite this upset, Cabán’s campaign has been heralded as one of the most stunning victories of the new anti-establishment Democratic Party, paralleling Alexandria Ocasio-Cortez’s defeat of powerful Queens Democratic machine candidate Joe Crowley almost a year ago (Nixon, New York Magazine). In a speech at the New Visions Democratic Club debate in Jackson Heights on April 29, Cabán asserted, “Who I am and what I fight for has been shaped by my experiences in over-policed, over-criminalized and resource-starved communities.” Her platform encompasses the reversal of economic and racial inequality in policing, increasing funding for schools rather than prisons, an end to mass incarceration and the war on drugs.

This election has exciting implications for the work of DSW and the broader #decrimsexwork coalition. A memo instructing fellow DAs not to prosecute sex workers and their customers has been pledged as one of Cabán’s first priorities if she were to take office. Not only would this change the lives of sex workers in Queens, increasing rights and safety through the legitimization of their work, but it shows the effects of decriminalization to be real and meaningful. In a Vice article, former Manhattan assistant DA Marie Solis describes how, when the District Attorney declines to prosecute an offense, it functions as a demonstrative trial run for how decriminalization can improve public safety—and pushed for legislative action, as with the decriminalization of marijuana possession. The decriminalization model, proposed by DecrimNY and endorsed by Cabán, would repeal parts of New York penal code that criminalize prostitution and especially target transgender women of color (Solis, Vice).

At DSW, we believe the current decriminalization bill could use improvements, and we are excited by the possibility of promoting them with the help of our supporters. DSW is humbled and inspired by the hard work of so many in this community that made such a historic campaign possible—and honored to be involved in this exciting step towards rights and safety for all.

New York Legislator To Introduce “Stop Violence in the Sex Trades Act”

On June 10, Assemblywoman Julia Salazar, in tandem with local coalition DecrimNY, announced that she would be introducing a series of bills in the NY legislature that would fully decriminalize sex work in New York State. While it usually takes years to enact legislation into law, the mere introduction of the NY legislation fits with the trend of good legislation that has been introduced in states like NH, RI, and HI this year — something we haven’t seen in decades of organizing.

International Whores Day Anniversary Celebration – June 2, 2019

On June 2, 1975, more than 200 street-based sex workers in Lyon, France, occupied the church of St. Nazier to protest police corruption and brutality. They hung a banner declaring, in French, “Our Children Do Not Want Their Mothers in Jail.” Every year since then, sex workers and their allies have celebrated the continued survival and resistance we continue to face.

In New York City this year, DSW hosted a picnic in northern Brooklyn that approximately 40 people attended. Occupying public spaces and celebrating is an act of resistance that honors the hundreds of sex workers who occupied a sanctuary and inspired millions of future activists to do the same.

Mexico City’s Decriminalization Law Not Yet Implemented

Mexico City lawmakers voted 38-0 on May 31, 2019, to decriminalize prostitution in the nation's capital city. Rep. Temistocles Villanueva from the ruling center-left Morena Party says that the law is intended to help crack down on sex trafficking in the city, as well as recognizing that consenting adults have a right to engage in sex work.

Elvira Madrid, founder of a sex work rights group in Mexico, welcomes the change in the law. Other human rights groups also say that decriminalization will strengthen anti-trafficking public policy if appropriate legislation follows (Reuters, 2019). The law has not yet been implemented, but legislators are hopeful about results.

“Black Trans Lives Matter!!” Rally at Washington Square Park

May 24, 2019

New York Transgender Advocacy Group (NYTAG) held a rally in Washington Square Park to honor the three Black trans women who were killed this year within a span of eight days. DSW stands in solidarity with trans women of color who are fighting and dying on the front lines of the war against sex workers. We joined a coalition of organizations in New York to draw attention to violence against members of the trans community, many of whom are impacted by the criminalization and increased surveillance of the sex trade.

When we listen to sex workers and stop the arrests, we free up marginalized members of our community to advocate for safer working conditions and enable them to report violence against them, reducing the violence. Decriminalizing sex work is a crucial first step toward creating a society in which we are all free to be our authentic selves without shame or stigma.

DSW Hosts Unity Reception in NYC

May 2, 2019

DSW hosted a delightful evening that was both a celebration and a rallying cry at the Cornell Club in NYC. With exquisite performances by Essence Revealed and sweet jams by DJ Mikey Palms, speakers included Dame Catherine Healy (from New Zealand), Ceyenne Doroshow, and DSW’s Kaytlin Bailey. Activists, donors, and reporters came together to celebrate and commit to the long road ahead fighting for a future where we listen to sex workers and offer help — not handcuffs.

Our guest of honor, Dame Catherine Healy, is a former sex worker and lifelong activist who was bestowed the title “Dame” by Queen Elizabeth II for her successful campaign to decriminalize sex work in New Zealand. She has worked toward better working conditions for sex workers for over 20 years. She treated those gathered to some incredible insight and inspiring words. We will all look back on that night in the difficult years to come.

She came to the United States to meet with us and other activists to strategize and discuss her methods for achieving her legislative victories. In addition to joining us in New York, she also offered compelling testimony in Rhode Island and met with activists in San Francisco, Seattle, and Honolulu.

Experts Urge RI Legislators to Study Decriminalization

After months of planning and inviting an all-star cast of witnesses, DSW had its first hearing before the House Judiciary Committee of the Rhode Island Legislature. State Rep. Anastasia Williams (D) presented bill H5354, which would create a temporary commission to study the effects of laws prohibiting commercial sexual activity. Approximately 15 witnesses, invited by DSW and COYOTE Rhode Island, testified in favor of the bill, with no witnesses opposed. The potential study commission would be a crucial first step to legislative acceptance of decriminalizing sex work, as the commission is expected to provide accurate data and thoughtful recommendations to state officials in early 2020.

We had more than 35 letters of support from individuals and organizations all over the country including Amnesty International, St. James Infirmary, Dame Catherine Healy, SWOP Behind Bars, and many more.

This lobby process and bill could not have been possible without the incredible work and partnership with COYOTE Rhode Island and students, faculty, and staff at Brown University.

DSW Billboard Challenges Lawmakers in Florida

Multiple police departments in Florida have recently staged news conferences to cast themselves as heroes who have “rescued” women from “slavery” … by handcuffing them. 

Devastating stings that result in criminal records and broken families are common, but when Robert Kraft, the widowed owner of the New England Patriots, received a high-profile hand job it provided an opportunity to show people what these “rescue” operations actually look like.

The billboard shows a Chinese woman being arrested, which is exactly what Florida police officers did to the 14 working at 10 massage parlors in south Florida. Handcuffs are not help. Arrest is not rescue. Policing is not protection.

We hope that what’s happening to sex workers in Florida is a national wake-up call and a teachable moment. We all want to stop trafficking, violence, and exploitation within the sex industry. No one is more invested in stopping this abuse than sex workers themselves. Instead of arresting them, we should be listening.

This billboard, which DSW workshopped, designed, and sponsored, was up for four weeks in April and May 2019 to highlight the hypocrisy of doing prostitution raids in the name of “human trafficking.”

Sex Workers Host News Conference in Florida

All eyes are on Florida because of the high-profile stings on massage parlors. DSW teamed up with sex workers and allies in Florida to draw attention to what criminalizing sex work actually looks like: vulnerable women in handcuffs. DSW and SWOP Behind Bars staged a news conference in Orlando to push the messages of LISTEN TO SEX WORKERS; JUST STOP THE ARRESTS; and HELP, NOT HANDCUFFS.

SWOP Behind Bars, SWOP Orlando, SWOP Tampa, the Sex Worker Solidarity Network, and FL NOW stood together to stand up for sex worker rights and the women of Florida. They spoke about the devastating impact of arrests and the bad bills being pushed through the Florida legislature that would create a prostitution registry and increase police surveillance of sex workers.

Lawmakers want to help victims of human trafficking, but they can't do that if they refuse to listen to sex workers.

DSW and allies lobby RI legislators

DSW teamed up with COYOTE RI and allied organizations to educate RI legislators about the negative impact of criminalizing prostitution.

DSW’s lobbyists and local RI advocates engaged legislators in one-on-one conversations on the House floor to push for a study commission that would reexamine the state’s prostitution laws. Most RI legislators agreed that the laws aren’t working, while there’s uncertainty about what better laws would look like.  A study commission would provide the forum for discussing solutions.
