DSW and allies hold SESTA/FOSTA panel at SXSW

DSW teamed up with Alex Andrews from SWOP Behind Bars, Dan Savage, Larry Walters, and River del Llano from Uncage Love to discuss the dangerous implications of SESTA/FOSTA at a panel at SXSW in Austin. SESTA/FOSTA was the federal bill signed into law on April 11, 2018, which shut down services sex workers used to schedule and screen their clients.
The panel focused on the ongoing harm that SESTA/FOSTA is causing to the sex work community, in addition to the long-term implications for a broad range of civil liberties. Panelists also focused on the ongoing, multipronged strategies to challenge or repeal the law — and the increased energy and urgency the legislation created within the growing sex worker rights movement.
Dan Savage lent his expertise as a longtime LGBTQI activist and sex educator. Alex Andrews spoke to and for incarcerated sex workers, and Larry Walters is currently embroiled in litigation challenging SESTA/FOSTA's constitutionality, echoing the other panelists' observation that it’s simply indefensible.

This “friend of the court” brief was cosigned by an impressive array of organizations, including Sex Workers Project, National Coalition for Sexual Freedom, Brooklyn Defender Services, St. James Infirmary, and other allies.

The Electronic Frontier Foundation Files a Federal Lawsuit To Challenge the Constitutionality of SESTA
June 28, 2018:
Representing the Internet Archive, Human Rights Watch, the Woodhull Freedom Foundation, massage therapist Eric Koszyk, and Alex Andrews, and endorsed by human rights groups including the ACLU, Amnesty International, and Prostasia Foundation for Child Abuse prevention, EFF challenges the criminalization of protected speech.
On September 24, the suit is dismissed on the basis of lack of standing.
- In this case, the courts did not feel that plaintiffs in the case met injury-in-fact requirements. Injury-in-fact is defined as either having suffered or imminently suffering injury—an invasion of a legally protected interest that is (a) concrete and particularized, and (b) actual or imminent. Said injury can be financial or not. Additionally, the plaintiff must prove causation, traceable to the conduct being sued, and redressability, in that a favorable decision by the courts will redress the injury.
- Because the suit was dismissed on a basis of standing rather than the merits of the case, the circuit court did not rule on whether or not the law violated first amendment rights.
